OnBase Document Access is solely for the purpose of providing public access to Electronic Court Records from the Clallam County Superior Court. These documents are filed with and maintained by the Clallam County Clerk's Office. Only those records deemed to be opened to the public will be available. "Sealed" or "Confidential" record can not be obtained through/by this system. To gain access to this OnBase Document Access you must first register by providing your true and correct first and last name, email address, billing address, mailing address and your phone number. When you register, your username and password will be established and you will then be considered a Registered User / Registered Customer. This agreement may or may not apply (either in part or in its entirety) to specific Governmental Agencies listed in the U.S. Code / Regulations or in the Washington State RCW's as being "exempt" from these terms and conditions.
Registration is free. Washington State law, under RCW 36.18.016, established the fees for preparing, copying, or certifying records. Based on this the Clallam County Clerk's Office through OnBase Document Access and Official Payments (the financial vendor actually processing your payments) will be assessing fees. All registered customers will be charged as follows:
VISA, MASTERCARD AND DISCOVER CREDIT/DEBIT CARDS ARE ACCEPTED.
Clallam County Clerk's Office will make OnBase Document Access accessible only by use of designated passwords or other OnBase Document Access security measures. The Registered User is solely responsible for maintaining security of its OnBase Document Access passwords and for permitting the issuance of passwords to its employees and permitted OnBase Document Access Users. The Registered User is also responsible for all access to, and use of, the OnBase Document Access system - including but not limited to: features, data, information, and software by personnel (presently or formerly) employed by the Registered User or by means of the Registered User's equipment, whether or not the Registered User has knowledge of or authorizes such access and use.
Any Registered User (governmental or non-governmental) who deems the security or integrity of its OnBase Document Access password(s) or permission(s) has/have been breached, is solely responsible to immediately notify the Clallam County Clerk of this breech and request reissuance of new password(s) and or permission(s). Any actions, financial charges or other harm incurred to the Registered User who fails to promptly notify the Clerk's Office of such breach or misuse shall be fully responsible for the damages incurred. They Clallam County Clerk's Office is held harmless for any expenses incurred by the Registered User under these circumstances.
This agreement will become effective immediately upon use of OnBase Document Access by the Registered User. Clallam County Clerk's Office and/or OnBase Document Access may terminate this Agreement immediately at any time, without notice to the affected Registered User. The Clallam County Clerk's Office and/or OnBase Document Access reserve(s) the right to:
The Registered User may not copy, download, store, publish, transmit, transfer, trade, sell or otherwise use the data, or any portion of the data, in any form or by any means except as permitted by this Agreement. The Registered User shall not trade, sell, license or distribute data to third parties or use data as a component of or as a basis for any material offered for trade, sale, license or distribution.
Public Access to Electronic Court Records is supported by the charging of fees. Any attempt to collect data from OnBase Document Access in a manner which avoids billing is strictly prohibited and may result in criminal prosecution or civil action. OnBase Document Access privileges will be terminated if, in the judgment of Clerk's Office personnel, they are being misused. Misuse includes, but is not limited to; using an automated process to repeatedly access any portion of OnBase Document Access applications for purposes of collecting any information contained therein.
An account determined by the Clallam County Clerk's Office to be related to an account that has been subject to an action outlined above may also be subject to the same action. Accounts may be determined to be related based on information obtained by OnBase Document Access during registration or other contact with the Clerk's Office and OnBase Document Access.
The features, data, information, and other material on OnBase Document Access are the property of the Clallam County Clerk's Office. The Registered User may, through the use of OnBase Document Access, direct the transmission of the Clerks Office proprietary features, data, information, and related materials in electronic or other format to other parties for internal or personal use if such property except as may be restricted herein this User Agreement. The features, data, information, or other materials shall not be made available or disseminated to third parties without the written consent of the Clallam County Clerk.
Performance under this agreement is subject to interruption and delay due to causes beyond OnBase Document Accesss' or the Clallam County Clerks Offices' reasonable control such as acts of God, acts of any government, war or other hostility, civil disorder, the elements, fire, explosion, power failure, equipment failure, industrial or labor dispute, inability to obtain necessary supplies and the like.
There may be modifications, notices, or changes from time to time. If there are changes in a significant way, information regarding the changes will be posted on the OnBase Document Access System. It is the account holder's responsibility to check these Policies and Procedures regularly for changes. Continued use of OnBase Document Access following the posting of changes will mean that the account holder accepts and agrees to the changes.
This agreement will be governed by and under the laws of the State of Washington. Any litigation arising out of or relating to this Agreement shall be filed in Clallam County Superior Court, Port Angeles, WA.
